Durbin Creek Fence Rentals LLC – Terms and Conditions

1. Company Information:

Locally owned and operated, Durbin Creek Fence Rentals LLC provides professional-grade temporary fencing solutions

2. Rental Terms

Contract durations are customizable based on the project’s specific needs and timeline.
The minimum rental period is 7 days.

3. Pricing Structure

To reserve your long-term (greater than 30 days) fence rental and secure your scheduled installation, an initial payment is required at the time of contract signing. This payment includes:

• Installation and removal fees
• Maintenance coverage during the rental term
• The first month’s rental fee (if applicable)

This amount is applied toward the total rental contract and is non-refundable once scheduling and resource allocation have begun.
Note: This payment secures your installation window and ensures proper scheduling of labor, equipment, and materials. In the event of cancellation after contract signing, this initial payment will not be refunded due to administrative and logistical costs already incurred.
If the full contract is not paid upfront, the remaining rental fees will be invoiced monthly according to the agreed payment schedule.


4. Service Area & Delivery Requirements

Service Area and Delivery Requirements:
Durbin Creek Fence Rentals LLC provides delivery, installation, maintenance, and removal of temporary fencing within a 50-mile radius of Fountain Inn, South Carolina.

To ensure safe and timely service, the following site conditions must be met:

• Clear Site Access: Delivery locations must be accessible by truck and trailer, with adequate space for unloading and maneuvering.
• Forklift Access: Sites must be firm and level enough to accommodate equipment used during installation. Steep grades, soft ground, or tight clearances may limit service availability.
• Site Preparedness: The installation area must be free of debris, vehicles, equipment, or other obstructions prior to the scheduled delivery date.
• Customer Responsibility: It is the customer’s responsibility to maintain clear access to the site throughout the rental term. Delays caused by inaccessible or unprepared sites may result in additional fees or rescheduling.

Note: Service beyond the standard 50-mile radius may be available upon request and is subject to additional travel or delivery fees. Please contact us for a custom quote if your project is located outside the regular service zone.


5. Customer Responsibilities

Customer is responsible for:
- Ensuring reasonable care of fence panels and accessories
- Maintaining site conditions that allow for safe delivery and removal
- Carrying or ensuring contractor’s insurance to cover:
- Theft
- Vandalism
- Damage or loss of rented materials

6. Damage or Loss

The customer is responsible for all rented equipment from the time of delivery until it is removed by Durbin Creek Fence Rentals LLC.

If any fencing panels, gates, privacy screens, stands, couplers, or other rental components are lost, stolen, vandalized, or damaged beyond normal wear and tear during the rental period, the customer will be charged according to the current Replacement Cost Schedule.

Examples:
• Fence Panel – $150.00
• Pedestrian Gate – $73.80
• Stand – $36.26
• Coupler – $5.00
• 50' Privacy Screen (Solid Color) – $79.63
• 50' Privacy Screen (Logo/Custom Print) – price varies

Normal wear and tear caused by weather or standard use is expected and will not result in additional charges. However, damage caused by misuse—such as unauthorized relocation, using heavy machinery near fence lines, or stacking materials against fencing—may result in fees for repair or replacement.

Durbin Creek Fence Rentals LLC is not liable for injuries, delays, or property damage resulting from unauthorized use or customer negligence.

Customer Tip: Keeping your site secure, clear of obstructions, and protected from unauthorized access helps reduce the risk of damage or loss—and ensures your fencing performs safely and effectively throughout the rental period.

7. Limitations of Liability

Durbin Creek Fence Rentals LLC will perform all services in a timely, professional manner and to the best of our ability. However, we are not liable for any accidents, injuries, or property damage resulting from:

• Improper or unauthorized use of fencing materials
• Customer modifications or relocation of installed fencing
• Lack of site security or supervision
• Use of fencing for unintended purposes

Additionally, we are not responsible for service delays or disruptions caused by circumstances beyond our control, including but not limited to:

• Inclement weather
• Traffic conditions
• Equipment or material shortages
• Supply chain disruptions
• Site inaccessibility or unsafe conditions

In no event shall Durbin Creek Fence Rentals LLC, its owners, employees, or contractors be held liable for incidental, indirect, or consequential damages arising out of the use or inability to use the rented fencing or related equipment.

Important: The customer is responsible for ensuring the fencing is used safely and in accordance with the intended purpose of crowd control or site security.


8. Cancellation Policy
Contracts may be canceled in writing within 72 hours of signing for a full refund of any payment made, provided that no materials have been delivered or installation has been scheduled.

After 72 hours, the initial payment is non-refundable due to resource allocation and scheduling commitments.

If cancellation occurs after installation has begun, the customer is responsible for all incurred costs, including labor, materials, and any portion of the rental term already used.

Note: Rescheduling requests will be accommodated when possible, but are subject to availability and may result in additional fees.


9. Contract Modifications

Contract Modification:

All changes to the contract—including rental duration, fence quantities, installation dates, or payment terms—must be submitted in writing and approved by Durbin Creek Fence Rentals LLC.

Modifications are not considered valid until confirmed in writing by an authorized representative of the company. Additional charges may apply based on the requested changes.


10. Payment Terms

Accepted Payment Methods: Visa, Mastercard, Discover, ACH, or cash.

Two Payment Options:

Paid in Full Net 15 or 30 after signing of rental contract.
OR
Initial Deposit which includes:
- First month rental
- Installation, maintenance, and removal fees
- Delivery charges
With ongoing Rental Fees: Due 30 days after contract signing, then every 30 days for duration of contract time.

11. Governing Law
This Agreement is governed by the laws of the State of South Carolina, without regard to its conflict of law provisions.

12. Dispute Resolution

In the event of a dispute, both parties agree to the following:

1. Good Faith Mediation
All disputes will first be submitted to non-binding mediation in South Carolina.
2. Binding Arbitration
If mediation fails, disputes will be resolved via binding arbitration under the rules of the American Arbitration Association - Venue: Greenville County, South Carolina

- Each party will be responsible for their own legal fees unless otherwise awarded by the arbitrator.
By signing, both parties waive the right to bring any claims in a jury trial or class action lawsuit.

13. Website Use & Privacy

DCFR LLC does not currently offer online booking.
If online features are added in the future, customers will be required to review and agree to updated terms. A Privacy Policy is available and governs how we collect, store, and use customer data.

14. Acceptance of Terms

By entering into a rental contract with DCFR LLC, you acknowledge that you have read, understood, and agree to terms & conditions as laid out.
